PRIVACY POLICY

1. DATA CONTROLLER

The personal data of the sender and recipient will be processed by PAKEDIA:

2. PURPOSE

For the provision of the contracted service: The data will be processed to provide the requested forwarding service. The recipient’s data will be processed in order to proceed with the delivery and, when necessary for the effective provision of the service, the recipient will be required to prove their identity by means of their ID card and/or passport and a capture of their signature. In addition, and at PAKEDIA‘s request, it will be necessary to check that there are no signs of forgery. It is the Customer’s obligation to assess whether such validation is necessary and proportionate.

PAKEDIA shall not be liable for the recipient’s failure to provide proof of identity if the recipient decides to refuse verification of his or her identity details.

With regard to the delivery process, PAKEDIA will use the mobile phone and email to manage the delivery both with the transport company and, where applicable, with the customs authorities (the transport company will inform you of the day of delivery, incidents, absences, delays, etc.). The Customer declares and accepts that PAKEDIA has their consent to use them for the aforementioned purposes.

PAKEDIA may also use the data provided to send commercial e-mails, newsletters, discounts, and for any other commercial purpose, provided that the Customer has given their consent. The Customer may object to this processing in their personal Customer area on the website www.pakedia.com.

Compliance with legal obligations

PAKEDIA may disclose your data to the Public Administrations and Courts, provided that such information is required in the established legal processes.

Statistical information and assessment of the service

PAKEDIA has a legitimate interest in knowing how its customers rate the service, with the aim of improving the service and offering products and services that better meet their needs.

For these purposes, PAKEDIA may conduct satisfaction surveys by telephone or e-mail, and this information will be used by PAKEDIA. To do so, we will anonymise it to prevent the information from being linked to your person, so that we can carry out statistical and econometric studies.

Provided that you have given your consent, PAKEDIA may send you commercial information related to the provision, improvement and updating of our services. This information may be generic or personalised, and in the latter case it is necessary to process your data beforehand in order to profile you, determine your tastes, preferences and needs, and thus identify the offers that are best suited to those references.

3. WHAT DATA DO WE PROCESS?

In accordance with the purposes set out above, the personal data that we use can be divided into two categories: data that you provide directly to us as the contracting party, ensuring the veracity and legality of the same, which PAKEDIA may use for the purposes set out above; and data derived from the provision of the service, such as the history of contracted services, characteristics, complaints or requests for information.

4. COMMUNICATION OF DATA AND INTERNATIONAL TRANSFERS

PAKEDIA will transfer your data to the contracted transport companies, as this is essential for the service to be provided. The transport company will act as Data Controller. It is not foreseen that your data will be communicated to persons other than PAKEDIA and the contracted shipping companies, but the following exceptions may occur: In order to comply with legal obligations, we may be obliged to communicate data to third parties, such as Public Administrations or Courts.

Likewise, in the case of international shipments, it is essential that the contracted transport companies communicate the details of the sender, the recipient and the description of the goods to the customs authorities, as well as to the destination transport operator and the other parties involved in the delivery. However, as there is a possibility that they may be in a country whose data protection regulations have not been declared adequate by the European Commission and may not provide adequate guarantees for the legitimate processing of the data. You can consult the List of Countries whose data protection regulations provide an adequate level of security on the website of the AEPD and the European Commission. This transfer of data is legitimate as it is necessary for the provision of the service by the sender, in accordance with article 49.1.b) and c) of the RGPD.

5. CONSERVATION PERIOD

The data will be kept for as long as they are necessary for the development of the contractual relationship. Once this period has elapsed, they will be deleted in accordance with data protection regulations, implying their blocking. They will only be available at the request of Judges and Courts, the Public Prosecutor’s Office or the competent public administrations during the period of limitation of any actions that may arise. Depending on the type of service, in general the statute of limitations for most civil actions is five years.

6. EXERCISE OF RIGHTS

You may exercise your rights of access, rectification, portability, limitation of processing, deletion, opposition through any of the following channels, indicating the right to be exercised and enclosing a copy of your National Identity Document or equivalent document as well as any other documentation you consider appropriate:

On the website of the Spanish Data Protection Agency (AEPD) you can find information and a series of models that will help you to exercise your rights. We also inform you that you have the right to lodge a complaint with the supervisory authority (in Spain, the AEPD) in the event that you consider your rights have been infringed.

Likewise, you may exercise your rights of access, rectification, portability, limitation of processing, deletion and opposition against the transport company through the channels provided for this purpose by the company.

7. PROCESSORS

In cases where PAKEDIA acts as data processor, it undertakes to:

  • To process the data for the aforementioned purposes and on the instructions of the sender. Within the delivery service, in order to provide the best service, the national identity document, telephone number or email address may be used to inform the recipient of estimated delivery dates, deal with any incidents and carry out satisfaction surveys. For this purpose, PAKEDIA may use the services of other third parties (sub-processors), if necessary for the provision of the service and operations of the contract and/or for its maintenance and provided that: PAKEDIA, at its express request, may make available a list identifying the sub-provided services and the identity of the sub-providers; In the event of non-compliance by the sub-provider, PAKEDIA remains fully responsible for the sub-provider.
  • Implement the appropriate legal, technical and organisational security measures to ensure a level of security appropriate to the risk, as set out in art. 32 of the GDPR and, at your request, we will inform you of the risk analysis methodology used.
  • Destroy or return the data processed, as well as any supports or documents containing the data processed, without prejudice to the possibility of retaining this data, duly blocked, under the terms provided for in our data protection regulations.
  • Ensure compliance with the rest of the obligations set out in the data protection regulations.
